Welcome to Ziegler Locks ("the Company", "we", "us", or "our"). By accessing our website located at zieglerlocks.ca (the "Site") or requesting, booking, or purchasing our residential or automotive locksmith services, you agree to be bound by the following Terms of Service ("Terms"). Please read them carefully. If you do not agree to these Terms, you must immediately cease using the Site and our services.
1. Scope of Services, Base Service Charge, Travel Fees, & After-Hours Dispatches
Ziegler Locks provides mobile residential and automotive locksmith services throughout Hartney, MB, and the surrounding Westman region.
- Base Service Charge & Travel Fee Policy: A Base Service Charge of $50.00 plus a Travel Fee of $0.70 per kilometer (calculated one-way from Hartney, MB) is due upon confirmation of dispatch / arrival. This fee covers mobile dispatch, vehicle setup, and travel expenses, and is non-refundable regardless of whether the requested job is ultimately completed, cancelled upon arrival, or refused by the Client. A $50.00 deposit may be required prior to being dispatched for any service request.
- Service Call Rates (Based on one-way distance from Hartney, MB):
- Base Service Charge: $50.00 flat fee per service call.
- Travel Rate: $0.70 per kilometer (one-way from Hartney, MB).
- After-Hours Surcharge: A +$60.00 flat rate applies to any dispatch confirmed before 7:00 a.m., after 5:00 p.m., or anytime on Sundays and Holidays. This surcharge is in addition to the Base Service Charge and Travel Fee.
- Note: Base service, travel, and after-hours fees are completely separate from, and in addition to, final service labor and hardware charges. All service call and dispatch fees are due upon arrival and are strictly non-refundable.
2. Invoicing, Payment Terms, & Service Finality
- Invoicing & Due Date: The Business will invoice the Client immediately upon the completion of residential or automotive locksmith services. Payment is due in full upon receipt of the invoice. For automotive services, payment is due in full on-site upon receipt of the invoice and prior to the release of any newly cut keys, programmed remotes, or the vehicle itself. If an invoice remains unpaid 30 days following the service date, the Business reserves the right to initiate legal action or collections to recover the outstanding balance, plus any applicable administrative and interest fees.
- Accepted Payment Methods: Payment shall be remitted using major credit cards (Visa, Mastercard, American Express, Discover), debit, contactless mobile payments (Apple Pay, Google Pay), cash, or Afterpay financing processed securely through Square. Interac E-transfer may be accepted only upon express prior approval.
- Service Finality & Refund Policy: All locksmith services completed as described are final and not subject to refunds. Once on-site work/technical work has officially commenced—including but not limited to lock picking, hardware disassembly, drilling, rekeying, tool setup, lock decoding, high-security key cutting, or transponder chip and remote programming attempts—the Client will not be reimbursed or credited for any services cancelled mid-job. All hardware sales, custom-cut keys, transponder keys, and remote fobs are final upon installation, programming, or delivery.
3. Identity, Ownership Verification, & Authority
- Security Compliance: To ensure security compliance, prevent unauthorized property or vehicle access, and satisfy provincial auditing and liability requirements, the Client agrees to provide a valid government-issued photo ID and proof of authorization (such as a utility bill, lease agreement, property tax assessment, vehicle registration, insurance documents, or a bill of sale) prior to the completion of services.
- Data Archiving: The Client explicitly authorizes the Business (Ziegler Locks) to document, verify, and securely archive images or records of these verification documents, along with the Vehicle Identification Number (VIN) or property entry points, within our secure, encrypted customer database. All data is handled strictly in compliance with Canadian privacy laws (PIPEDA) solely for verification, fraud prevention, and liability protection.
- Authority to Order Service & Indemnification: The Client represents and warrants that they are the lawful owner, registered legal owner, authorized tenant, or legally designated agent of the residential property or vehicle listed, and have full legal capacity and authority to order lockout, entry, key generation, re-key, programming, or repair services for the specified location or vehicle. The Client agrees to indemnify and hold harmless the Business (Ziegler Locks), its agents, and employees from and against any and all claims, damages, liabilities, and expenses (including legal fees) arising from a breach of this warranty or any claim by a third party that the Business performed services without proper authorization.
4. Pre-Existing Conditions & Limitation of Liability
The Client acknowledges that the Business (Ziegler Locks) is responsible only for damages directly and solely caused by the negligent execution of its own work and services. The Business shall not be held liable for any damage, deficiencies, defects, or issues existing on the residential property, premises, or vehicle prior to the commencement of the job, including but not limited to:
- Pre-existing damage to doors, frames, trim, walls, or paint.
- Worn, stripped, weathered, or failed internal mechanisms of existing lock hardware, ignition cylinders, door locks, or trunk locks.
- Brittle, worn, or weathered door handles, window seals, and internal linkage rods affected during standard lockout bypass procedures.
- Pre-existing electronic, transponder, immobilizer module, or computer faults (ECU/BCM) within a vehicle's electrical system occurring during key programming or technical decoding.
- Structural shifting, alignment issues, or warped doors that affect lock function.
- Surrounding fixtures, flooring, wiring, dashboard elements, steering columns, or structural elements near the work area.
5. Legal Framework & Claim Limits
- Shortened 6-Month Claim Window: Any claim, lawsuit, or legal proceeding arising out of the services rendered or parts installed by the Company must be formally filed within six (6) months from the date the service was completed. Failure to bring a claim within this window constitutes a complete, unconditional, and irrevocable waiver of the claim, and it shall be forever barred, notwithstanding any longer statutory limitation periods permitted under provincial law.
- Mandatory Individual Arbitration & Class Action Waiver: Any dispute, claim, or controversy arising out of or relating to this Agreement shall be settled by binding arbitration in accordance with the Arbitration Act of Manitoba, conducted strictly on an individual basis. The parties explicitly agree to split initial filing and administrative arbitrator fees equally, with final cost allocation to be determined by the arbitrator. The parties explicitly waive any right to commence, join, or participate in any class action lawsuit or representative proceeding against the Company.
- Recovery of Legal Fees: In the event that any legal action, small claims court proceeding, or arbitration is brought by either party to enforce, interpret, or defend claims arising under this Agreement, the prevailing party shall be entitled to recover from the non-prevailing party all reasonable attorney’s fees, legal costs, court costs, and actual disbursements incurred from the inception of the dispute through all appeals.
- Force Majeure & Delays: The Company shall not be held liable or responsible for any delays, failure to perform, or damages resulting from circumstances beyond its reasonable control. This includes, but is not limited to: severe weather events, blizzards, frozen locks or hardware, road closures, hazardous driving conditions, acts of God, labor shortages, supply chain disruptions, or third-party manufacturer software failures.
6. Entire Agreement & Severability
- Severability Clause: If any provision, sentence, or clause of this Agreement is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable under applicable local or provincial laws, that specific provision shall be modified or severed to the minimum extent necessary. The invalidity of such provision shall not affect the validity, legality, or enforceability of any other part of this Agreement, which shall remain in full force and effect.
- Entire Agreement & Amendments: This contract, along with any digital service agreements or custom clauses acknowledged via Square Contracts, constitutes the entire agreement between the Client and the Business regarding the specified services. Any changes, additions, or modifications to the scope of work or these terms must be agreed upon by both parties in writing or acknowledged via an updated Square digital invoice/agreement. We reserve the right to modify these website Terms at any time without prior notification. Your continued booking of services or navigation of our Site following updates constitutes absolute acceptance of the revised Terms.
